General Terms and Conditions
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed in our online shop. Our shop is exclusively tailored to the needs of consumers, i.e., private individuals who do not purchase products or services for commercial, industrial, or professional purposes. This ensures a user-friendly, secure, and transparent shopping experience for end consumers.
2. Contractual Partner, Conclusion of Contract, Correction Options
Brie AG is your contractual partner for all online purchases. When a product is displayed in the online shop, we make a binding offer to conclude a purchase contract. You can initially add products to the shopping cart without commitment and adjust or correct your selection at any time – clear instructions guide you through the entire ordering process. The contract is concluded when you click the order button and thereby accept our offer. Immediately after submitting your order, you will receive a detailed confirmation email, ensuring maximum transparency and security.
3. Language of Contract, Storage of Contract Text
Contracts can be concluded in German, English, French, or Italian. We securely store your contract text and send you both order details and our GTC in text form. Additionally, your contractual documents are always accessible in a convenient manner via your personal customer login.
4. Delivery Conditions
Delivery Options
We deliver conveniently and reliably to the address you specify. Shipping is purely postal; personal pickups or deliveries to pack stations are unfortunately not possible. This ensures a controlled and traceable shipment of your ordered goods.
5. Payment
5.1 Prices
For your online purchase, the total prices indicated at the time of order apply, which already include statutory VAT. You benefit from complete price transparency without hidden costs.
5.2 Due Date and Default in Payment
The price is due immediately upon conclusion of the purchase contract unless alternative payment terms are specified.
For consumers: In case of default, a reminder fee of 1.50 CHF per additional reminder may be charged. However, you retain the right to prove a lower damage.
For entrepreneurs: In case of default, we reserve the right to charge default interest of eight percentage points as well as a flat rate of 40 CHF.
5.3 Payment Methods
Our online shop offers you a wide selection of secure and flexible payment methods:
Credit Card:
After entering your data, your card will be charged immediately with the invoice amount. To protect your data, the transaction is carried out according to proven security standards.
PayPal:
Pay conveniently with PayPal by using your account and authorizing the payment directly online. The secure PayPal platform provides additional buyer protection. Special options with PayPal, such as installment purchase, depend on your individual PayPal customer rating.
Sofort by Klarna:
With an online banking account activated, you pay directly and securely, with your account being debited immediately after the order.
Klarna:
Both purchase on invoice and installment purchase are available; both options require a successful address and credit check. With purchase on account, you settle the amount after receiving the goods and invoice within 30 days. The installment purchase allows flexible repayment rates, at least 1/24 of the total amount. Please note that additional payment methods offered by Klarna are available, over which we have no direct influence.
Invoice:
You receive the goods and settle the invoice amount by transfer to our account; this payment method is available after a successful credit check.
6. Right of Withdrawal
As a consumer, you enjoy the voluntary right of withdrawal in accordance with the withdrawal policy. This allows you to test whether the ordered goods meet your expectations risk-free and to easily return unsuitable products.
7. Retention of Title
Until full payment of the invoice amount, the delivered goods remain the property of Brie AG. In justified cases, we may register a note in the retention of title register to secure your rights as well as our own.
8. Data Security
Your data security is important to us. You are responsible for regularly and properly backing up your personal data. We do not assume liability for losses that could have been prevented through proper backups. Exceptions are damages caused by us, our legal representatives, or agents acting with gross negligence or intent, especially in cases involving injury to life, body, health, or contractual obligations, as well as under the warranty law and product liability law.
9. Warranty and Guarantees
Your statutory warranty rights remain fully in effect unless we have expressly agreed to different conditions. If additional guarantees exist, you can find all details directly on the product in the online shop or on special information pages. Upon receipt of the goods, you should promptly examine the items and report any defects immediately. Later complaints can only be considered if they concern hidden defects discovered only upon use. In such cases, send the affected product with a detailed defect description back; the transportation costs are your responsibility. The correction is carried out either through repair or replacement, at our discretion. If the subsequent fulfillment is unsuccessful, you are entitled to withdraw from the contract – price reduction is excluded. For used goods: claims due to defects that occur after one year are excluded; within the first year, statutory limitation periods apply.
Your claims for warranty or damages remain, especially in cases of intentional or gross negligence, violation of life, body or health, essential contractual obligations, or existing guarantees.
